TAN SRI PETER CHIN FAH KUI POSITION AS PARTY PRESIDENT IS CONSTITUTIONAL AND LEGAL
1. Article 18(1)(i) & (ii) of SUPP Party Constitution provides two (2) category of party delegates and which read as follow:
“18. (1) The Delegates’ Conference shall be held once in every 3-year consisting of:-
(i) the existing members of the Central Committee; and
(ii) Delegates duly elected by the Branches. Each Branch shall be entitled to send one delegate for every 250 members or part thereof provided that every Branch shall be entitled to send at least 2 delegates and at most 70 delegates.”
2. Tan Sri Peter Chin Fah Kui and Dato’ Sebastian Ting Chiew Yew were the members of Central Committee for the office tenure from year 2009-2011. It means both Tan Sri Peter Chin and Dato’ Sebastian Ting Chiew Yew are automatically 1st category party delegates falling under Article (8)(1)(i) for the TDC meeting held at Dec 2011, which had in turn elected members of Central Committee, members of Central Working Committee and Tan Sri Peter Chin Fah Kui as Party President and Dato’ Sebastian Ting Chiew Yew as Publicity Secretary.
3. As Tan Sri Peter Chin Fah Kui and Dato’ Sebastian Ting Chiew Yew were not the party delegates falling under the 2nd category under Article 18(1)(ii) who need to be elected by the branch during Bekenu Branch General Meeting and Miri (Piasau) Branch General Meeting held in year 2011, the deregistration of Bekenu Branch and Miri (Piasau) Branch would not affect or invalidate the legal qualification or status of Tan Sri Peter Chin Fah Kui and Dato’ Sebastian Ting Chiew Yew as party delegates eligible to be elected into Central Committee and President Post and Publicity Secretary. Since they are the automatic party delegates (1st category) by virtue of their position as member of Central Committee in year 2009-2011, the act of electing them into Central Committee by Delegates’ Conference in year 2011 is constitutional and legal.
4. Therefore under Article 18(1)(i) Party constitution it is legal and constitutional for Tan Sri Peter Chin to maintain and continue as Party President of SUPP. It is baseless and misleading for Dato’ Sri Wong Soon Koh to accuse and question the legal status of Tan Sri Peter Chin Fah Kui as President of SUPP.
