Datuk Sebastian on the Federal Court dismissal of Petronas case
Sarawak United Peoples’ Party (SUPP) State Assemblyman for Piasau and Secretary general of the party, Datuk Sebastian Ting expressed great joy when the Federal Court dismissed Petroliam Nasional Bhd (Petronas) application for leave to commence proceedings against the Sarawak state government. The Sarawak legal counsel had proven their case.
Ting who represented SUPP went with the legal team headed by Sarawak State Attorney-General’s Chambers comprising State Attorney-General (SAG) Datuk Talat Mahmood Abdul Rashid, State Legal Counsel Dato Sri JC Fong, deputy SAG Saferi Ali, and legal officer Mohd Adzrul Azlan thanked them for doing an excellent job.
He congratulated the Chief Minister for leading the team forward and added that this is a happy day for all Sarawakians and he thanked them for their prayers and moral support.
Ting said it is no doubt that oil and gas are properties of Sarawak and hoped that Petronas will work together with Sarawak for the interest of all.
Chief Judge of the High Court of Malaya Tan Sri Wira Ahmad Maarop awarded RM50,000 cost to the Sarawak state government.
Senior federal counsel Shamsul Bolhassan held a watching brief on behalf of Attorney General’s Chamber (AGC).
Petronas filed an application for leave to commence proceedings under Article 4 (4) of the Federal Constitution, seeking a declaration that the Petroleum Development Act 1974 (PDA) applied with regard to the regulatory control of upstream activities in Sarawak. It also seek a declaration that the Sarawak Oil Mining Ordinance (OMO) 1958 was impliedly repealed by the PDA.
Petronas claimed its exclusive regulatory authority for the upstream industry throughout Malaysia, including in Sarawak.
