Wilfred Yap Questions Legitimacy of Petroleum Development Act in Sarawak

Kota Sentosa State assemblyman, Wilfred Yap rejected claims by former Treasury official Nik Ahmad Azmi Nik Md Daud that the Petroleum Development Act 1974 (PDA) was a “voluntary harmonisation” agreed by all states.

Yap argued that Sarawak, as a founding partner of Malaysia under the Malaysia Agreement 1963 (MA63), cannot be equated with Malayan states and never consented to the PDA through its Legislative Assembly. He said the signing of Vesting Deeds by the Chief Minister in 1974 did not reflect the democratic consent of Sarawakians.

He added that the 5 percent royalty was never equitable and that the PDA, passed under political pressure, merely shifted control from foreign concessionaires to Petronas in Kuala Lumpur.

“The legitimacy of the PDA in Sarawak remains in question because the Legislative Assembly never consented to it,” Yap said, stressing that Sarawak has every right to renegotiate unfair terms under MA63.
