国会下议院在10月17三读通过2024年联邦宪法(修正)法案,确保海外出生的马来西亚母亲子女能够自动获得公民身份,赋予马来西亚女性与男性同等的权利。 这一修正案修改了《联邦宪法》附表二第二部分第1(b)和第1(c)条,将原本的“父亲”字眼改为“父母中至少一方”。这一改动意味着马来西亚女性与外籍配偶所生的海外子女将与马来西亚男性所生子女享有同等的公民权。在修正案通过之前,只有马来西亚父亲所生的海外子女可以自动获得马来西亚国籍。 人联党中央妇女组主席许德婉在一篇文告中表示,作为一名长期推动此项改革的人士,她感到非常荣幸和感恩能有机会在今年年初与马来西亚内政部讨论拟议这项修正法案,为性别平等奠定了新的里程碑。 “自2018年以来,我一直为马来西亚母亲所生外国儿童的公民身份努力,对修正案的通过深感欣慰。这不仅是为了公平正义,也为许多家庭带来了希望。” 美中不足的是,该修正案并不具备追溯效力,这意味着在修正案通过之前出生的海外子女无法自动获得公民身份。现有的马来西亚母亲为外国出生子女提出的公民申请案件仍将按照程序处理。 令人遗憾的是,修正案还通过了将无国籍儿童申请马来西亚国籍的年龄上限从21岁降至18岁。 “我个人有一些超过18岁的无国籍儿童的个案正在处理当中,这一修正可能让他们的情况更加复杂。” 无论如何,许德婉认为这项修正案的通过,标志着马来西亚在性别平等和公民权问题上迈出了关键的一步,也带来了新的希望。未来也会继续密切关注公民身份申请程序和相关政策。
