{"id":9127,"date":"2016-01-25T17:44:31","date_gmt":"2016-01-25T09:44:31","guid":{"rendered":"http:\/\/www.suppnewsportal.com\/main\/?p=9127"},"modified":"2016-01-25T19:48:46","modified_gmt":"2016-01-25T11:48:46","slug":"dato-sebastian-on-trans-pacific-partnership-agreement-tppa","status":"publish","type":"post","link":"https:\/\/www.suppnewsportal.com\/main\/?p=9127","title":{"rendered":"Dato Sebastian on Trans-Pacific Partnership Agreement (TPPA)"},"content":{"rendered":"<p>First and foremost, SUPP would like to thank our Chief Minister Adenan Satem for securing the Administrative Empowerment (Phase 1) from the Central Government.<\/p>\n<p>Such empowerment actually encourages more Sarawakians to be involved in managing Federal Civil Service in the State especially with the appointment of Sarawakians as heads of civil service departments.<\/p>\n<p>&#8220;Nevertheless, SUPP interest lies more with the Phase 2 which touches on our State Rights under the Malaysia Agreement 1963 and Phase 3 which touches on Financial Management and Entitlements&#8221; said SUPP Secretary general, Dato&#8217; Sebastian Ting.<\/p>\n<p>It has come to SUPP\u2019s attention that the Trans-Pacific Partnership Agreement (TPPA) which is going to be debated in the Parliament very soon actually has some impact on Sarawak\u2019s oil and gas ownership.<\/p>\n<p>Based on the TPPA document provided by the Ministry of International Trade and Industry (MITI) in \u201cAnnex IV Malaysia\u201d page 5, it says, \u201cPetroleum Development Act 1974 (PDA 74) vested PETRONAS with the entire ownership in, and the exclusive rights,\u2026of exploring, exploiting, winning and obtaining\u2026petroleum and hydrocarbon resources, whether onshore or offshore of Malaysia\u201d.<\/p>\n<p>SUPP strongly disagrees because after the lifting of the Proclamation of Emergency on 24 November 2011 under Article 150 (7) of the Federal Constitution, the ownership of our Territorial Waters returns back to Sarawak. Our Territorial Waters are further protected under the Malaysia Agreement 1963 and the Inter-Governmental Committee (IGC) Report.<\/p>\n<p>Furthermore, SUPP does not agree that PETRONAS is the sole entity that may award petroleum exploration, development and production contracts to other companies in our Territorial Waters because this authority should now belong to the State Government of Sarawak.<\/p>\n<p>We as the owner have the Rights to decide who should be our Contractors to engage in exploration, development and production of petroleum and hydrocarbon resources via the State issuing licensing and permits, although this has yet to be given official acknowledgement by the Federal Government.<\/p>\n<p>As the TPPA is to be an International Treaty with several other countries involved, it is deemed pertinent that the State Government highlight this potential breach of the Malaysia Agreement 1963 and the Inter-Governmental Committee (IGC) Report before it becomes a fait accompli as far as ownership is concerned by the fact that our Parliamentarians vote for the TPPA to be enforced.<\/p>\n<p>We should not forget that our Dewan Undangan Negeri (DUN) had given the mandate to the Sarawak State Government on 8 December 2015 to reconcile all Federal Laws to tie in with the Malaysia Agreement 1963 (MA63) and the Inter-Governmental Committee (ICG) Report.<\/p>\n<p>It will be a great embarrassment to those concerned when, in the reconciliation process, establish that the Petroleum Development Act 1974 (PDA 74) is no longer applicable to Sarawak because the Federal Government no longer owns the Sarawak Territorial Waters.
