SUPP Public Complaints Bureau (SUPP PCB) Chief\u00a0 Wilfred Yap was recently approached by a landowner surnamed Tan from Matang, Kuching who requested for his assistance to appeal to a power utility company for\u00a0 adequate compensation as a result of a\u00a0 power utility company erecting a Tower Base for a transmission tower on his land.<\/p>\n

SUPP PCB was informed by Mr Tan that the power utility company had previously offered to pay the sum of\u00a0 RM2,140.00 as compensation but that he had in August 2015 rejected the proposed compensation as he felt that it was not adequate.\u00a0 The said Mr Tan also informed SUPP PCB that he had not received any further response from the power utility company after his rejection of their proposed compensation.<\/p>\n

In view of his predicament, he had approached and requested SUPP PCB Chief, Wilfred Yap for advice and assistance on how best to solve his predicament. Upon the request for assistance, SUPP PCB Chief, Wilfred Yap have written an appeal on Mr Tan’s behalf for the power utility company to look into his predicament and for their consideration of an adequate compensation which\u00a0 reflected the market value of his land used by the power utility company as a tower base for a transmission tower.<\/p>\n

SUPP Public Complaints Bureau understands the landowner’s predicament and will try its best to mediate between the parties for\u00a0 a win-win situation. SUPP PCB Chief, Wilfred Yap will continue to follow up and monitor the situation until an amicable conclusion\u00a0 to the satisfaction of all affected\u00a0 parties are agreed upon.<\/p>\n

For general information, the Federal Constitution provides that \u2018no person shall be deprived of property save in accordance with law\u2019; and \u2018no law shall provide for the compulsory acquisition or use of property without adequate compensation\u2019. It is therefore imperative for landowners to understand their rights to ensure that these rights are protected and adequately compensated in the event of compulsory acquisition. In Sarawak, Section 60 of the Sarawak Land Code (Cap.81) specifies the matters to be considered\u00a0 in determining the amount of compensation to be awarded for land compensation.<\/p>\n
