Wilfred Yap helps Association members
SUPP Public Complaints Bureau (SPCB) Chief Wilfred Yap was recently approached by members of an Association comprising of purchasers of seventy three (73) commercial units in the shopping mall situate in Kuching for his assistance to appeal to Land & Survey Department to expedite the application for sub-division and issuance of individual strata titles to the units within the commercial building.
According to the members of the Association, the said shopping mall project was completed and occupation permits was issued in 2013 and vacant possession of their properties were delivered to them. However the members of the Association inform that after six (6) years, the individual subsidiary strata titles to the units they purchased have still not been issued. This is despite Section 17(1) of the Strata Titles Ordinance 1995 which provides that application for the issue of separate subsidiary titles should be made within six (6) months after the issuance of occupation permit.
The members of the said Association inform that many of them are unable to secure tenants for their units and many tenants have also vacated prematurely because of the low customer crowd to the shopping mall. As such, some members of the said Association are facing financial difficulties to service their bank loans without the benefit of tenants.
The members of the Association informed that without the issuance of the individual strata titles, a Management Corporation comprising owners of units in the shopping Mall cannot be formed. The members believe that they will be able to contribute positively their ideas and suggestions through a Management Corporation in the maintenance and management of the shopping Mall building to boost its popularity to attract more customers and visitors.
SUPP Public Complaints Bureau have on behalf of the members of the Association appealed to Land & Survey Department to expedite the issuance of individual strata titles in the shopping mall building to reduce the predicament that they currently face. The same letter have also been copied to the Chief Minister, YAB Datuk Patinggi (Dr) Abang Haji Abdul Rahman Zohari Bin Tun Datuk Abang Haji Openg and YB Datuk Dr Sim Kui Hian, Minister for Local Government & Housing for their assistance on the matter.
