Wilfred Yap helps disgruntled house buyers
A group of house buyers who were very disappointed with the defective condition of their completed houses in a housing estate situate at Jalan Datuk Amar Stephen Yong was assisted by SUPP Public Complaints Bureau Chief Wilfred Yap.
Yap said the house buyers told him that the defects in their houses requires major rectification works can be considered as unsafe and unfit for occupation. This is despite the issuance of the Occupation Permit by Padawan Municipal Council on the 5th July 2018.
The frustrated house buyers had approached Yap for assistance because they were unhappy with the issuance of the Occupation Permit by Padawan Municipal Council as it would affect the calculation of quantum of damages that can be awarded by Tribunal for Housing Purchaser’s Claims Sarawak (Tribunal Tuntutan Pembeli Rumah Sarawak) against the housing developer under the Sale & Purchase Agreement. The said Occupation Permit was issued after the housing developers’ consultant architect and structural engineers had submitted the statutory Form E & F.
Padawan Municipal Council has now requested the housing developers’ consultant architect and structural engineers for their explanation concerning their application for issuance of occupation permit on behalf of the housing developer. Padawan Municipal Council have also given their assurance that they will deal with the matter seriously, which can include refering the submitting persons for the issuance of the occupation permit to their professional bodies.
Yap said he will continue to assist the house buyers in respect of their claim at Tribunal for Housing Purchaser’s Claims Sarawak and pursue, follow up and monitor the matter with all the relevant authorities until the issue of compensation and rectification works are completed in full compliance with the terms of the sale & purchase agreement between the house buyers and developer.
